Getting it on video

Postby marlener » July 16th, 2012, 3:44 pm

Can video surveillance be used in court or can someone be charged using it.Eg a recording of a robbery. I was listening to a heated discussion yesterday concerning this.the SOE videos that came out came up.

^ That raises so many different legalities, only way to really know is to test it in a court and appeal before the privy council to establish a case law. Sorry to be vague but many scenarios can play out from just that case, eg was anyone shown the tape, the mere possession of the tape etc

Now the actual recording may/may not be legal but the tape itself raises other issues.

And honestly this is out of my forte so i will let some other legal mind comment further.

Is Video tape evidence is now admissible in the U.S. now? If so, what is hampering them from making it admissible here?

^ The amendments and proper laws are being put in place as i understand it. Presently it can be admissible, however only by a professional who has to prove their training/knowledge in court (Expert Witness)

The home video was seen by no one else,So if a thief come in my yard and steals my car and I get it on security video, the individual cannot be arrested, because i am not a professional!?? What then is the point of me having cameras then?

^ It assists the police in their investigations. Most criminals are known, the police knowing who it is allows them to pursue enquiries differently.
