the car is SUPPOSED to be impounded as its part of the case but when ya pocket fat n ya chain long no need to abide by the laws of the land.

sad that different classes receive different justice in this country.

Nope, following the accident the car should be taken to a station and have a Motor Vehicle Inspector ( Licensing Officer) check it for defects( namely brakes, steering etc) after that it is free to be released/sold etc

so you are saying in a vehicular manslaughter case the car does not need to be impounded until a ruling/verdict is made?

he's right. basically to determine if it was negligent driving, or negligence through poor maintenance. add tires to that list (the genii who buying "slightly used" better take note).

It should also be part of evidence in a CRIMINAL matter before the court.

Baboolal trial put off as witnesses fail to show up

The trial of Henry Baboolal, who is charged with causing the death of PC Adahha Maynard last September, had to be adjourned yesterday after several witnesses failed to show up in court. Baboolal, 43, an engineer of Schooner Drive, Westmoorings, reappeared before Chief Magistrate, Marcia Ayers-Caesar in the Port-of-Spain Eighth Court. The son of the former Senate president, Dr Linda Baboolal, is charged with driving under the influence and death by dangerous driving.

Maynard, 23, of Broome Street Heights, Diego Martin, died after being struck by a car while on his way to work at the Four Roads Police Station around 6.45 pm on September 25, 2011. Maynard, who had five years service as a police officer, died on the spot. When the matter resumed yesterday, Baboolal sat in the prisoner’s dock while his parents, Linda and Dr Michael Baboolal and a male relative were seated in the visitors’ gallery.

Baboolal, a father of two, is out on $100,000 bail. When the matter was recalled on July 25, PCs Cario and Joseph were cross-examined by attorney Gilbert Peterson, SC who leads the defence team which includes Fitzgerald Hinds. Attorneys Keith Scotland and Asha Watkins, who are representing Maynard’s family were also present yesterday. Unable to proceed yesterday, Peterson and Scotland agreed to a short adjournment of September 18 as Ayers-Caesar issued summonses’ for the witnesses to be present on the next occasion.

They need to get serious about witnesses that "didn't show up". From Police Officers to the average man.......... ridiculous

ALMOST ten months after PC Adahha Maynard was knocked down and killed while on his way to work, the preliminary enquiry into his death got started in the Port of Spain Magistrates' Court.

Charged with causing the officer's death is 46-year-old Henry Baboolal, the son of former Senate president Linda Baboolal.

He reappeared before Chief Magistrate Marcia Ayers-Caesar in the Eighth Court yesterday for the start of the enquiry in which two police officers gave evidence.

In addition to the charge of causing Maynard's death, Baboolal also faces a charge of driving while under the influence of alcohol.

Following the testimony of the officers—PCs Carrio and Joseph—of the Four Roads Police Station, they were both cross-examined by defence attorneys Gilbert Peterson SC and Fitzgerald Hinds, who are representing Baboolal.

The offences for which he is charged are alleged to have taken place on the evening of September 25, last year.

On that day, Maynard, 23, of Broome Street, Diego Martin, was walking along a pavement at Morne Coco Road, Diego Martin, when he was struck by a vehicle. He died instantly.

Maynard was last attached to the Four Roads Police Station and was on his way to perform extra duties at the station when the incident occurred.

Seeking the interest of Maynard's family in the enquiry are attorneys Keith Scotland and Asha Watkins.

The enquiry will resume on September 4.
