Point fortin traffic ticket

Postby nemisis » June 18th, 2016, 5:30 pm

I went through the traffic light by PFC while Amber heading into point. Police trap after the light, officer says I broke the red. How does one go about contesting the ticket.

Don't. If you have no proof and it's your word against theirs, the magistrate will believe them unless they are caught lying.

Sometimes I wonder what's the point, I was doing 40 so I coudnt get it for speeding, seat belts on, no handling of cell phones ,no loud music ,no tint on vehicle, insurance up to date, license up to date but no dash cam so hard luck. You can't prove it so guilty by default

There's an easy way to beat a ticket of this type, especially wrt going through an amber.

I was going through the lights in the Croisee on green, when a PH car stop on me in the intersection. When he moved the light was on amber. The police car on the next side chased me down and stopped me in front Scotiabank. I asked them how they stopped me but not the man dropping off passenger in the middle of the intersection. He said he didn't see that. I told him I just came to the bank and left my permit home. He told me to bring it to the sub station .
I went back home and forget about them ,this is Sunday morning I talking about. Next thing I see the police car swing in my yard. The one on the left ask me why I didn't come to the station, I told him I forgot. Sadist telling me , you know the ticket is ah grand? I say ,de boss just give me the ticket nah, I go pay it. I take it like a man, rather pay the court $1000 than give them $500.

Amber light means to stop once it is safe to do so. If you were going at 40km/h as you claim, the police officer probably thought that you could have come to a stop safely and not ended up in the middle of the intersection. Hence your ticket.

,^^^ INTERSECTION??? I'm pretty sure you don't know the light in question. It's on a stretch its purpose is to allow children to cross the road safely to get into the school not to allow a second line of traffic to cross...

If there was an intersection I would have gotten away as I don't proceed into them without it being clear for me to get out. A few years ago I was in bumper traffic at coca cola lights la romaine and get caught in the intersection as lights turned. I was half a car length over the stop line because light changed Amber and with traffic no way was I making it across. The police officers doing stop and search came out of the intersection where he was standing and stood next to the car. A second officer who was on opoosite side dealing with a stop finishes walks up and wants to know why I didn't stop before the line. WTF. Ignore the cars actually blocking the flow of cars along the east west passage but harrasing me who blocking no one but over the line. Since then I'm extra careful with intersections.

eh RS... since nemisis brought up the talk about dash cams, would a dash cam video of the said incident be taken into consideration in a courtroom? That would show that nemisis did indeed cross on an amber and not red...

Sad that you got a ticket for this light. Months now this crossing defective and constantly going on red as if people are trying to cross. I feel children stick gum or something inside the switch.

No, it would not be able to be tendered as evidence by an individual. Wouldn't help in this instance though, amber means stop once safe to do so. If he was really driving slowly, observing the lights and still went through he's guilty.

Well then this is more straightforward. You did not stop on the amber light. You broke the law. You got the ticket. What is the fuss about?

But you went through the amber and you were supposed to stop. Okay, so the policeman, assuming that you heard him right, said you broke the red, when he should have said that you broke the amber light. But that does not change the fact that you broke the law. You were supposed to stop on the amber and you ran it. Just go pay the ticket for not obeying the law.

Is there a law for breaching an amber or is the charge for red?

Amber light means stop once it is safe to do so. You could get charged for running an amber depending on where you were in relation to the traffic light when the signal changed to amber.

(d) the full amber signal shown alone shall be taken as prohibiting vehicular traffic from proceeding beyond the stop line except in the case of any vehicle which when the signal first appears is so close to the said line that it cannot safely be stopped before passing the line;

Check bullet item (d) of Clause 102 on page 191 of the above link

Without breakin the speed limit bro. If he go in court and say he was speeding they might give him another ticket. And he cant say he was driving too fast to stop without also admitting he was speeding. Coocoo cook.
