Reassignment, Revocation and Appointment of Minsters

Prime Minister Dr the Honourable Keith Rowley today (April 09, 2018) advised Her Excellency Paula-Mae Weekes, President of the Republic of Trinidad and Tobago of the following in accordance with Sections 3(9) and 76(3) and 79(1) of the Constitution of the Republic of Trinidad and Tobago:

(i) reassign Mr. Darryl Smith as Minister in the Ministry of Housing and Urban Development;

(ii) reassign Ms. Shamfa Cudjoe as Minister of Sport and Youth Affairs;

(iii) reassign Mr. Randall Mitchell as Minister of Tourism;

(iv) revoke the appointment of Mr. Maxie Cuffie as Minister of Public Administration and Communications and reassign Mr. Cuffie as Minister in the Ministry of Public Administration and Communications;

(v) appoint Ms. Marlene Mc Donald as Minister of Public Administration and Communications; and

(vi) revoke the Prime Minister’s assignment as Minister with responsibility for Public Administration and Communications, and in addition to his present duties as Prime Minister, appoint him as Minister of Housing and Urban Development.

Tantie Kams needs to visit a dentist ASAP. But she's right about her removing then Ministers for less.

Remember people were saying Marlene had something on them hence her re-appointment? Looks like Bamsee Squeezer has something on them too:

This is a pretty fkn dotish move.

Smith probably gran charge with a step down and a by election threat, no other reason to keep him....

It's one thing to condone the behaviour....it's another to endorse a man fkn dumb enough to ignore so many close calls and continue with the behaviour.

Mr. Darryl Smith’s Appointment Revoked

Today, (April 10, 2018) Prime Minister Dr the Honourable Keith Rowley advised Her Excellency Paula-Mae Weekes, President of the Republic of Trinidad and Tobago in keeping with the provision of Section 3(9) of the Constitution of the Republic of Trinidad and Tobago, to revoke the appointment of Mr Darryl Smith as Minister in the Ministry of Housing and Urban Development.

This following a meeting between the Prime Minister, the Minister of Planning and Development, the Honourable Camille Robinson-Regis and Mr Smith during which new information came to the attention of the Prime Minister.

The meeting also resulted in the appointment of a committee to thoroughly review the circumstances surrounding the dismissal and payment of compensation to Ms Carrie-Ann Moreau at the Ministry of Sport and Youth Affairs.

The committee is to be chaired by former Permanent Secretary and Human Resource Expert Ms Jackie Wilson, and includes Ms Folade Mutota of WINAD and Attorney-at-Law Ms Elaine Greene. The committee is expected to report in two weeks.

It is anticipated that all parties involved in any non-disclosure arrangement in this matter will lift such impediment so as to allow the fullest examination of the facts for the benefit of the public.

On Wednesday July 26th, 2017 the Chairman of the San Juan Laventille Regional Corporation declared the seat of the electoral district of Barataria vacant.

However, Persad-Bissessar charges that since the death of Councilor Bruno, no step has been taken either by the Minister of Local Government or the Cabinet to satisfy the president that the seat of the councilor for the electoral district of Barataria has become vacant and to advise the president to exercise the power to issue the writ addressed to the Returning Officer of the electoral district of Barataria for the election of a new Councillor.

The same applies in the case of the late Councillor Rajpaul.

A statement by the UNC says Persad-Bissessar is acting on behalf of two registered electors in each electoral district who are seeking to challenge the Rowley Cabinet.

Persad-Bissessar stated that the action of the Rowley Cabinet has undermined and continues to undermine our democracy.

“The failure of the Cabinet to act in accordance with the constitution and the law has resulted in a subversion of the rule of law and this action cannot be allowed to continue to the detriment of thousands of constituents who remain unrepresented,” Mrs. Persad-Bissessar stated in her letters.

The proposed claimants seek to challenge the action of the Rowley Cabinet on the grounds that the inaction of the Cabinet in failing to act in accordance with the constitution and the law is illegal, being in breach of section 1 of the Constitution, and amounts to an abuse of power by this administration. In addition, the inaction of the Cabinet is contrary to law, is illegal, amounting to a breach of section 4 (b) of the Constitution of the Republic of Trinidad and Tobago and is unlawful.

On behalf of her clients, Persad-Bissesar noted that “The Supreme Court is the ultimate interpreter of the Constitution and to this Court is assigned the delicate task of determining what is the power conferred on each branch of Government, whether it is limited, and, if so, what are the limits and whether any action of that branch transgresses such limits. It is for the Court to uphold the constitutional values and to enforce the constitutional limitations. That is the essence of the rule of law”.

She stated that this was the jurisdiction that the proposed Claimants were prepared to invoke to seek relief against Dr. Rowley and his Cabinet.

Persad Bissessar is calling upon the Rowley Government to act within the next seven days or face the courts.
