Basically after talking to insurance we are being told they they will give us the current value which is normal for their job. However, we never asked for our new vehicle to be hit and written off and we never asked to be screwed without a vehicle now and money from insurance that will never get back a new hilux like what we had.

I want someone who can verify if i can have a case against the people to claim for the difference to be able to get back another van.

I think any lawyer will tell you this up front. Face the realities of life. You're very emotionally charges up right now.

1. Nobody ever asks for an accident. But sheit just happens. That's why you got insurance.
2. The value of any vehicle depreciates once it leaves the showroom.

Not so it does work pappi. Before you even get back the wreck ,they have already worked out the value ,which is what it was new less depreciation , or the sum insured if applicable ( where in some cases people insure for less than the actual value ,which is another story ) .the salvage value is deducted from this sum if you decide to keep the wreck. You don't get the pre -accident value and the wreck . in any event you get back what it's valued at the time ( which is calculated by the adjuster) .

If you retain the wreck and sell it for more than the salvage value , that is the only way you can get more than what they offered you. Usually the figure the adjuster put is within a few thousand for the most. Most of the time ,once you're in an accident and the car is " written off " ,you lose . if you owe the bank , or other finance companies ,they will pay them ,not you. You will then have to re- negotiate a loan for another vehicle. The remaining time and value on the policy is also lost.

Op, which insurance company? By the way , the Adjusters put a range. The can put an upper and lower limit on the values. Most times the insurance use the higher value on the salvage, in order to pay you less if you're keeping the wreck. You can demand to know the values and can also negotiate a higher figure. I bought an H100 recently that the adjuster valued at $45g for $25g . Most of the vehicles we have for storage are sold for less than the salvage value after they are advertised and nobody is interested. Sometimes way less.

Insurance is a racket proven time and again.
I guess if you owe the bank a fresh loan then them having to pay it off is the only way they kinda don't win the most.
Since the amount owed is not not subject to adjustments by an adjuster.
