Adult Toys ILLEGAL in T&T?

Postby QuietGiant » August 17th, 2018, 11:03 pm

So according to Customs, it's apparently illegal to buy/sell adult toys in Trinidad now, even if it's bought for personal use. We sure we in 2018? Was that always a thing? Also illegal are camouflage print items, seeds, cigarettes, honey, soil, toy guns, shoes, game controllers, headphones and more.
Next they gonna tell you what to do in the privacy of your own bedroom?

http://www.looptt.com/content/customs-c ... adult-toys

Unlike the UK, where one can walk into stores like Ann Summers, or Adam and Eve in the US, and buy adult toys, in Trinidad and Tobago it is illegal to import one even for personal use.

E-courier Websource reminded customers on Friday via email that the item is listed as prohibited by the Customs and Excise Division and will be confiscated if imported, even if the item is for personal use.

“As part of our efforts to maintain the efficiency of our operations, we will be updating you periodically with both new procedures and reminders of any applicable policies.”

“These updates are important as they will contain valuable information to help keep your online shopping and shipping experience enjoyable.”

“Please note that Customs will be inspecting all packages to ensure compliance with law. As such, they can and will seize the items listed below and any other prohibited items. This is not an exhaustive list,” the company said.

The list includes adult toys, items with camouflage print, seeds (except with the relevant permits), cigarettes, honey, soil and toy guns, among others.

Meanwhile, Head of the Women’s Institute for Alternative Development (WINAD), Folade Mutota, told LoopTT she finds the prohibition ‘curious’, asking what, if any, security risk the items would pose.

A representative from the Customs and Excise Division said the prohibition stems from old legislation regarding the use or sale of pornographic items which has never been changed.

Under Section 46 (g) of the Criminal Offences Act, any “person who offers for sale or distribution, or who exhibits to public view any profane, indecent, or obscene, paper, print, drawing, painting, or representation” may be ‘deemed a rogue and vagabond’ and found liable to imprisonment for two months.

Likewise, under Section 7 of the Summary Offences Act, “any person who is convicted on indictment of…any public and indecent exposure of the person; any public selling or exposing for public sale or to public view of any obscene book, print, picture or other indecent exhibition” can be found upon conviction liable to ‘any term warranted by law’.

Some stores listed on Facebook and listed as based in Trinidad have advertised adult toys for sale.

From my experiences it's only green camo that's illegal here, even in other Caribbean Islands, got braced by police in Bim for wearing a camo arm-less and had to buya Bob Marley T-Shirt from a vendor and surrender the camo vest at a concert entrance.

Nah bro is all camo, if you meet a gladman customs officer they'll seize anything regardless of camo pattern, same if you meet certain police officers. Dunno about the gaming controller but I won't put anything past dem fellas when the vaps hit them

As for the toys, it's not a new law but a very old one that's been used infrequently over the last few years. They just started back opening packages and seizing stuff so Websource sent out the email to aware customers

Utterly ridiculous. Grey blue and pink Camo? Really? Is that DF standard issue?

And of course the public doesn't question the arbitrary nature of these laws, so the authorities get another reason to waste time harassing the public. The powers that be just get so mired in upholding all these old rules and laws that they never take the time to stop and ask "wait, is this law effing ridiculous and/or antiquated?"

Toys used to be an underlow product, then as the law wasn't acted upon it became an open product with stores opening catering extensively to such items, now store owners are concerned having invested hundreds of thousands in stock

IIRC it has something do do with you not supposed to wear the color and design of the defense force

Defence Force Act 1962, as amended
219. A person, other than a member of the Defence Force, who without lawful excuse (the proof whereof shall lie on him)—
(a) wears the uniform or any portion of the uniforms of a member of the Defence Force; or
(b) wears any costume or any article of clothing or apparel so closely resembling the uniform or any portion thereof of a member of the Defence Force, as may cause such person to be mistaken for a member of the Defence Force, is liable on summary conviction to a fine of one thousand dollars and to imprisonment for eighteen months.

and griffith talks about it here...

remember this >>> https://www.tv6tnt.com/news/local/griff ... 5972b.html

newsdauy wrote:Former National Security Minister Gary Griffith calls for amendment of 'outdated' law on camouflage wear, says ban on all types, colours, sizes and material in camouflage serves no purpose.

Following is the text of a press release he issued today:

I wish to have it noted that the law regarding camouflage in this country is totally outdated and inappropriate, and the extreme laws stating that all types, colours, sizes and material in camouflage serves absolutely no purpose in ensuring that national security is maintained.

Laws must not be imposed simply to inconvenience citizens, but are imposed solely to ensure systems of rules are established to govern behavior.

When laws are established, it can be based on five different Principles. The Laws that involve ensuring National Security stability is based on the “Harm Principle’, whereby these Laws are enacted to protect people from being harmed by others.

The initial Law established for camouflage being illegal was by the Trinidad and Tobago Defence Force in the Defence Act whereby it was ruled that “any camouflage that resembles that of the Armed Forces is illegal’. This may be deemed appropriate as persons can acquire camouflage green that is used by our Defence Force and they may attempt to imitate them hence affecting the security of a citizen.

However, this has proven to now be so farfetched worldwide, that in most countries this does not take place, and camouflage can be seen being worn by many persons in most countries, as it is a pattern and fashion and not a crime. Because one can then also consider banning the material and colour worn by the Police, as this can also be acquired and used to imitate an Officer.

It is only a handful of countries in the world that camouflage in the resemblance of the military is deemed illegal, mostly in the Caribbean .

Nevertheless, even if this Law may serve some purpose, what is totally irrelevant is the Customs Law that bans ‘ALL” colours, patterns, material and sizes of camouflage as if a pattern is a crime.

Whilst as Minister of National Security, I met with relevant officials to alter this Law that serves no purpose, but this as with dozens of other policies have also been shelved.

The reason why it is being mentioned now is that on the front page of the Newsday dated April 26, 2015 , it has a baby wearing camouflage.

As unbelievable as it is, that is a criminal offence.

How can a baby wearing a camouflage outfit, be illegal?

Likewise, pink short pants, camouflage underwear, a fluorescent blue camouflage lady’s purse, are all the examples of what is ‘deemed ‘illegal’, based on an outdated law that does nothing to ensure that the ‘Harm Principle’ is effective.

A baby wearing camouflage cannot in any way be a harmful possibility to anyone.

It is recommended that this Law be immediately revamped, to state as what was prescribed in the Defence Act, that “ only camouflage in the resemblance of the Defence Force is illegal and if used as such to imitate someone from the Defence Force” ,and not a pink camouflage purse or a yellow camouflage high heel shoe being illegal, as this is making a mockery of the Law.

prob we shud have a meeting with out elected leaders to have this fixed... but alas.. this is not the case

Outdated brains.

How d frack pink cammo is imitating the regiment?

Imo, no cammo should be illegal.
Use the emblems of police/regiment whatever to indicate protective services, and then ID cards to verify.
