Express pursues legal action against Braveboy



A THREAT of legal action has been issued by the Trinidad Express to social media blogger Marcia Braveboy for defamation of character after she used her facebook page over the weekend to post a false image of what she said was the front page of Sunday’s Express.

In her post, Braveboy accused the newspaper’s editor-in-chief Omatie Lyder and Sunday Express editor Curtis Rampersad of displaying poor taste in journalism by publishing a front page that did not even make mention of the death of secretary general of the Sanatan Dharma Maha Sabha (SDMS) Sat Maharaj the day before.

The posted image was that of an illegally copied Sunday Express front page that was photo-shopped, and which had the potential of leading social media users to believe that the newspaper had ignored Maharaj’s death and instead gave prominence to an article involving reggae artiste Prophet Benjamin who was bitten by one of his neighbour’s cats.

A pre-action protocol letter was issued to Braveboy yesterday afternoon, threatening a legal claim if she did not withdraw all posts, comments and statements related to the defamation, use social to issue an apology, pay damages in the sum of $250,000 each to Lyder, Rampersad and the Express for harm suffered as well as all legal fees incurred.

My understanding of this little blurb is that in addition to the cleanup and apology, cumulative damages to the tune of $750k and legal fees must be paid as well. In lieu of same, they'll meet in court. So it's not just 'hard luck dey, ah didn't know', but a 'say yuh sorry, pay we we morney and don't let it happen again'. I stand to be corrected though.
