Did you make it clear to N&M that you wanted to purchase a 2013 model year Tucson? Or did you just assume that because you paid for it in May 2013 that automatically you would be getting a 2013 model? Did N&M not deliver a vehicle meeting the specifications in the agreement that YOU SIGNED with them? How exactly did N&M misrepresent what they were selling?
These are a few questions that you have to HONESTLY answer to yourself before you go accusing N&M of what, according to the case you are trying to present, is tantamount to fraud. If you did not do your homework properly and dot all your "i"s and cross all your "t"s, whose fault is it that you got a 2012 Tucson?
You really ought to feel sorry for the "poor" people who are buying a 2004 model year Nissan X-Trail "Classic" at 2013 prices from N&M. Probably if you think of your vehicle as a Tucson Classic, you won't feel so bad.
You should call the Consumer Affairs Division and ask their opinion. Just ensure that you have all the paperwork concerning the vehicle in order.
