LF Good Industrial Relations lawyer

not for me personally, but for a friend, who is seeking some legal counsel on a work-related issue
The gist of it is the person was passed over for a promotion, the vacancy was not advertised, and the person hired is not qualified for the job, so said friend is expected to train his boss to run the department
He's just trying to find out if he as any legal recourse, I suppose...

He could try the Conciliation Division of Ministry of Labour first (if he already hasn't). Its free and they can advise further -

Maybe your friend can consider using the Equal Opportunity Commission, if he feels discriminated or has a 'status' that constitutes that. Also free as the M.O.L suggestion above.

Also MG Man, he can seek advice at a Union. Some of them, will accept any type of worker, so the person can join and get legal representation there.

Tell you bro to move on and start looking for another Job. To much stress loss time, fees. Trini unions and equal opportunity commission will not seek you bro best interest.

Once an employer shows that type of behaviour then its time to move on. Take an employer to court and its level victimisation and frustration.

Always leave gaps in knowledge transfer
Dont ever teach an employee everything jus so

It's a loss case, unless if he has lawyer family that will go all the way for him.

Private employers even worse. Time for him to move on. I keep telling trinis employees there is no such thing as employer loyalty.
Seen cases like his over and over again, if u rail up then its victimisation for you. Nothing you can do but get out.

He could refuse to train the person. He wasn't skilled enough for the position therefore he isnt skilled enough to train them

friend of mine just got 500k settlement through a union taking up his case.

based on a lawyers recc he went to the union and they took up the case..

let him investigate it ...nothing to lose.

Where I work, we are not unionised. However, someone's employment was terminated and he thought the dismissal was unfair. He went to National Union of Domestic Employees (NUDE) and they took up his case and went to court. Their lawyers won his case for him and he collected a settlement for the unfair dismissal.

EOC helped me heaps in my case.
They may be able to sort this out too. I was at the EOC office and met a person was there from the ministry of labour because they were being mistreated.

Unions can only help in discrimination or victimization cases if they are the represetative body in that place of employment.

But even if u don't have a union, u should still join one on ur own. They can help u if u are wrongfully dismissed.
