!!! below is the laws governing the traffic wardens
Pursuant to Section 3(1) of the Motor Vehicle and Road Traffic (Enforcement and Administration) Act;
Chapter 48:52 a Traffic Warden is empowered to issue a fixed penalty ticket to any driver found to be
in breach of any offence listed in the First Schedule to the said Act, such breaches include:
· Breach of Parking Laws
· Breach of Seatbelt Laws
· Breach of Mobile Phone Regulations
· Breach of Road Traffic Signs
· Breach of Traffic Lights
Provision for the appointment and functions of Traffic Wardens is stipulated in Section 10A of the
Motor Vehicles and Road Traffic Act; Chapter 48:50 and, as such, Traffic Wardens possess full authority
for the regulation, control and enforcement of traffic to:
· Stop a vehicle
· Request drivers’ permits
· Order the removal of illegally parked vehicles
Section 10A (3) of the Motor Vehicles and Road Traffic Act; Chapter 48:50 states:
Any driver who:
a) fails to comply with the directions given by a Traffic Warden while on duty;
b) obstructs a Traffic Warden in the execution of his duty, or aids or incites any other person not to
comply with the directions of a Traffic Warden or to obstruct a Traffic Warden in the execution of his duty,
is guilty of an offence and is liable to fine and imprisonment in accordance with the law.
The attire of the Traffic Wardens on patrol will be:
· White shirt with sleeves bearing the Official Traffic Warden Insignia
· Black trousers with yellow stripe
· Black hat with black and yellow checkered hat band
now they have power to issue tickets for the first scheduled offences, which is almost all of the traffice offences, however there are offences under the Motor and vehicle regulation, dont have a list, but they are a little different, they dont posess any power of arrest under this act, so if you were to disobey them, they will have to proceed by summons or call a police to assist, the general idea was that they go out with police and assist them in the execution of their duties, but we see them alone, anyways thats my contribution here!! so dont do as i did..you might meet one that is educated enough to know what their powers are and blaze your ass with tickets!!!!

Good stuff there konartis, but coming back to the OP’s Aunt’s situation, the TW was out of jurisdiction to trespass within the driver’s private property (this is what a counter-claim can amount to) and order the driver to proceed in the absence of a lawful authority, to a lawful authority for action to be taken. In other words, without the presence of a police officer, the cone had no right to do what he/she did and as someone said, the driver can now, in furtherance to registering a complaint with the PCA, can bring action of her own against the officer for trespassing on private property, kidnapping (although this may be far-fetched, since the driver did take the cone to the police station).
I don’t even think that most police officers would have entered the person’s vehicle on such a claim. They would usually direct the driver to report to the officer in charge at the nearest police station, and any Sergeant, Ag. Sergeant or higher ranking official would, upon hearing the driver’s claim, allow the person sufficient time (24-48hours) to produce proper documentation supporting his/her claim.
So, if the requirement for admission as a police officer is 3CXC, I ‘fraid to ask what the same is for cones?
