Machel to answer assault charges today

International Soca Monarch and Road March winner Machel Montano is expected to open his defence today to criminal charges stemming from a fracas at Zen nightclub almost four years ago. The international soca superstar, who was yesterday announced as the landslide winner of the 2011 Carnival Road March, will return before Magistrate Maureen Baboolal-Gafoor in the Port-of-Spain Fifth Court, where he is expected to testify under oath, about the events which transpired on April 26, 2007. Montano and entertainers Joel “Zan” Fezeck, Kernel Roberts, songwriter/producer and son of the late calypsonian Lord Kitchener and Rodney “Benjai” Le Blanc, are on trial before Baboolal-Gafoor on the charge of assaulting Russell Pollonais.
Montano, Fezeck and Roberts also are charged with assaulting Brandis Brown.
Montano also faces further allegations of assaulting Jenelle Le Chee and Gerard Bowrin and using obscene language.
The charges stem from a fracas outside the nightclub on Keate Street, Port-of-Spain, on April 26, 2007.
Montano, who is being defended by attorney Dana Seetahal, SC, was scheduled to testify in his defence on two previous occasions, but could not do so because of extraneous circumstances which had arisen and forced adjournments to the trial.
Baboolal-Gafoor, on December 9, called on Montano and the other defendants to answer the charges.
The magistrate said after reviewing the prosecution’s case, she found there was enough evidence for the accused to answer the charges. The soca superstar is expected to be cross-examined by prosecutor George Busby, who appears for the State. Following that, Roberts, Fezeck and Le Blanc will each present their cases. Roberts is represented by Keith Scotland, while Fezeck is being defended by Larry Williams.
Rajiv Persad, John Heath and Shalini Khan appear for Le Blanc.

Man deserve to be protected from that kinda assault. Herfriends were probably so high on the fact that she get a small wine that would have boosted if not skyrocketed her self esteem then they get real bummy when they realize that in the end she got rejected and it was all down hill again. Thats when they turned violent and well the rest is history. Its their fault for assaulting the guy and trying to continue it outside of the club.
They didn't even know who they got into a fight with. In the beginning they were also calling Bunji's name and he was in Arima at the time. They just called the names of the ones that they could get money from. You really feel that if Machel gets into a fight he will have to do any of the swinging himself. The amount of fans that he has - that would gladly put a beating on some haters. I would not be surprised that when the dust clears it is revealed that it was some bystanders that put a cutarse on LeBlanc because he and his crew offended their star.

The State is expected to resume its closing submissions at the assault trial involving reigning soca monarch Machel Montano, when the matter is recalled before Maureen Baboolal-Gafoor on April 2.
At yesterday’s hearing, State Prosecutor George Busby continued his closing submissions in the Seventh Court, touching on the evidence given by Montano’s co-accused Kernel Roberts during the trial.
Roberts, who is a songwriter and producer (the son of deceased calypso legend Aldwyn “Kitchener” Roberts) is jointly charged along with Montano, soca artiste Joel “Zan” Fezeck, and 2011 Young King Rodney “Benjai” Le Blanc. The four are accused of assaulting Russel Pollonais and Brandis Brown.
Montano also faces additional charges of assaulting Janelle Lee Chee and Gerard Bowrin, and for using obscene language.

In part of his submissions, Busby noted the inconsistencies between Roberts’ evidence and the evidence given by several of the State’s witnesses in the matter, and called on the magistrate to properly balance dichotomy between the two. Montano is being represented by Dana Seetahal SC, Roberts is being represented by Keith Scotland along with Daniel Khan, while Fezeck is defended by Larry Williams. Rajiv Persad, John Heath and Shalini Khan appeared for Le Blanc.
The four were first charged on June 4, 2007.
Machel assault case to end Sept 14
AFTER more than four years, September 14 was the date given yesterday in court for the conclusion of the assault trial against soca star Machel Montano and three other entertainers.
The State closed its case on April 2, but Magistrate Maureen Baboolal-Gafoor's decision had been delayed due to another round of legal arguments.
On that occasion, Montano's attorney, Dana Seetahal SC, had applied to the court to respond to State prosecutor George Busby's closing address, stating there were several inaccuracies in his submissions.
Busby, however, argued that according to law, Seetahal was not allowed to respond to his closing address as the State always had the final say in any matter before the court.
When the matter came up for hearing in the Port of Spain Seventh Magistrate's Court yesterday, Baboolal-Gafoor ruled in favour of the prosecution, denying Seetahal the opportunity to respond to Busby's address before adjourning the matter.
Montano, along with the son of the late Lord Kitchener, Kernel Roberts, Rodney "Benjai" LeBlanc and Joel "Zan" Feveck are all facing assault charges stemming from a fracas outside the Zen nightclub on Keate Street, Port of Spain, in April of 2007.
In June of that year, the four appeared before Magistrate Lianne Lee-Kim on the charges and each was granted bail in the sum of $50,000.
They were accused of assaulting Brandis Browne, Russell Pollonais, Janelle Lee-Chee and Gerard Borwin outside the club on April 26.
Montano faces an additional charge of using obscene language.
Montano, who gave ten days of evidence, denied the charges, saying he was the one being targeted by the group and they had verbally attacked him.
Roberts also testified while Feveck and LeBlanc exercised their right to not give evidence.
The assault trial involving reigning soca monarch, Machel Montano, and three other soca stars, has been adjourned one final time, as the presiding magistrate in the matter is still reviewing the sizeable amount of evidence, that was brought during the matter.
Although the case was expected to come to a close yesterday, when the matter was called in the Port-of-Spain Magistrates’ Seventh Court, Magistrate Maureen Baboolal-Gafoor instead apologised to the court, informing the relevant parties that she was still reviewing evidence.
“The court apologises for not being in a position today to deliver the ruling as expected, but I am sure that both the defence and the State are understanding that the court has to carefully consider all of the evidence which is before it,” Baboolal-Gafoor said.
The matter was then adjourned to November 23.
