So i thinking that most tuners are self employed and have some business experience they can share with young entrepreneurs....

So to being i have a question, how do you protect yourself from employees leaving with clients?

I had an employee that was involved in sales so he had access to vital company information....he left on bad terms and may have taken a contract from us....have any of you experienced this and how did you deal with it...

never give any employee vital info


keep that to yourself

The correct legal strategy is only really possible at the beginning of employment. The employee has to sign a restriction of trade agreement that forbids him from operating/competing or being employed in the same industry for a reasonable period of time say 2 years after leaving the company whether voluntarily or after termination. The court really has the final say on what is a reasonable period if and when it is ever challenged in court but a good lawyer can advise as per the type of business.

The employee also must sign a confidentiality agreement which basically protects you from him using trade secrets and certain company info that is not in the public domain to his advantage or to share with any other person or entity info that could compromise your competitive advantage(s). Although not absolutely necessary, the employee ought to be made to renew these agreements in writing every two years without ever including a renewal clause in the document.

Outside of the legal means, you could just identify a person that he cares alot for. Secretly take photos of this person as they go about their activities on several different days. Print the photos and mail them to him. Threaten to bring harm to that person and be prepared to actually carry out your threats. Kill someone if you have to. The point is to let him know you're serious.

Oh, remember to never touch the paper the photos are printed on, never touch the envelop or lick the stamp. Make sure none of your eye lashes or hair gets into the envelop. Destroy and discard the printer used to print the photos. Throw away the memory card the photos were taken from, never save the letter to your hard drive or other removable drive. After discarding the letter on the computer, overwrite several other letters and save these to the hard drive and then delete them. Defrag the machine and you're good.

Mr Gear....thanks man, i really didnt do that, cuz the guys was a personal friend, that was my bad... i learn from it tho....i just wanted to kno how i cud protect myself in future...

Seriously, I am a trained investigator. I have worked in the insurance and banking industries. I have operated my own private investigating company, provided security for visiting celebrities, I have managed a business for Ansa, I have operated quite a number of my own businesses and helped out during the initial stages of both Zorce and Trinituner. I am fascinated with business.

I'm currently in the Executive Masters of Business Administration and giving the other seasoned business professionals hell in trying to twist their thought processes to be more in line with mine. I'm having the time of my life.

Mr Gear, bess advice pal! ase_tt, we living in the real world and it have not one person in this world who could be 100% happy for you. I not saying that people do not want you to suceed and thing but they always wish they could have thinked about what ever you did and did it for themselves. So this falling out with you and your co worker was just an excuse for him to seek revenge but all in all the revenge wasnt for the falling out its probably because of jealousy!

^ Nope. It just means that he has temporarily gained an advantage with those clients. He now has to continue to please those clients and attract additional clients. That right there is the challenge he will face. Remember always that humans are creatures of habit so the moment he fails to deliver good service the clients can drop him and go right back to where they were before.

Remember this buzz... Those who do crimes with you will eventually do crimes against you. The client he stole knows the deal and will initially go with the new guy most likely for lower prices. Eventually they will each face a moment of truth and beyond that point just as the light shines on the prism someone will show his true colours.

I'm not a debt collector however I can conduct a means and assets investigation that will identify the debtors sources of income and their current and non current assets. If you take the person to court this will show the judge where the money can come from to pay off the debt. Outside of court you can provide the info to the debt collector for his use in settling the debt.

leave a few hot guns also if you can get your hands on them

Not really. That would at best just be constructive possession and this can be successfully defended. It could disrupt his operations for some time but it is not a complete solution and while the court case goes along he is still there able to steal more of your clients.

Additionally while the contraband is in your possession before you plant it, you run the risk of being caught red handed.

If you want lessons on the elements of successful war, read The Art of War very carefully. In war it helps if you have an underlying sinister nature coupled with a technical brain and a passion for detail.

The real mission ought to be to subdue the competition quickly without ever really engaging in all out war. You hardly ever want to set out to completely annihilate the opponent. This takes up too much time, energy and resources. It ought to be over before the other side even realizes that the war was on.

There are times when total annihilation is required but that is rare.

In addition to the first part of Gears advice -I would suggest that if your business is sales and you have employees building all the relationships-you leave yourself competing solely on price when the employees leave.

Make a point of taking ownership of all the accounts that you dont want to lose and make a point of interjecting yourself into the clients relationship with the co.
This means KNOWING your client and communicating with them. This will

Give the customer another contact and deepen their commitment with your co

Ensure you see problems as they develop and give you a chance to be pro active

And puts the employee in a position to question the customers loyalty wrt to whether the you personally have a better relationship with the customer.

Your franchise is the relationship with your clients.

And dont hire friends to do the biz.
