Exactly. I am very familiar with the EOT, and there are already two lay assessors, in addition to the judge, and there is a legit question as to whether a third lay assessor is needed. In order to have a matter called before the EOT, the complaint/ case MUST be referred by the EOC AFTER an investigation was done, and after there has been an attempt to conciliate. The vast majority of the complaints the EOC receives are not within the Equal Opportunity Act, so that many cases are closed off due to lack of jurisdiction. For the complaints that are within the EOC's jurisdiction, while I don't have the actual number, the parties tend to settle in conciliation (as this is a free service offered by the EOC, it is private and still legally binding). Very few are referred to the EOT.

So long story short, the EOT doesn't have that high volume of cases to even have hearings on a daily, much less weekly basis. I read the EOT's response as to why Ms Bhajan never assumed duties, and to me, it seems reasonable in that maybe there simply is no need for another lay assessor, when the case numbers being referred to the EOT are low, and when the economy is taking a hit due to the pandemic and we don't need to pay another person to sit around and do nothing.

It's not like it a CEPEP gig soldier :?
She had a legitimate expectation to fill an appointment for 3 years so much so that she left her private practice to take it up. Either way, however it is resolved, she will be compensated for what isn't her fault.

- It is not the same level, however, the tax payers would be funding a nice compensation package for someone to sit around and do very little. Like I said, soldier, there are already sit-in lay assessors on the panel and there is a legitimate question as to whether another is needed, and if the EOT has a reasonable justification as to why a third isn't required, and that someone was appointed to a non- existing spot on the Organizational Chart, then there is really no case. I do not know all the facts of the matter, but I am basing my comments on my knowledge of the EOT and what was published in the reports of this lawsuit. Like I said, to me, the EOT's response seems reasonable.

- An error was made, and yes, she had reasonable expectation to assume duties. The question is, however, who is responsible for this error? Can a President, simply because he or she has the power to do so, just appoint persons to high position on boards or state-run organizations? Was there a vacancy at the EOT? Can a president appoint someone as a lay assessor without consultation with the EOT? If yes, is there a cap on the number of appointments? Further detail is required.

Does this limit the number of lay assessors to 2???

(2) The Tribunal shall consist of a Judge of status equal
to that of a High Court Judge, who shall be the Chairman, and
two lay-assessors as may be appointed under or in pursuance of
section 42




It seems that the President has no requirement to consult with anyone. Although I agree that the President should find out IF they need a lay assessor before appointing one.

(3) The lay-assessors shall be appointed by the President
from among such persons as appear to the President to be
qualified by virtue of their knowledge of or experience in law,
religion, race relation, gender affairs, employment issues,
education, culture, economics, social welfare or human rights and
who have served in either of those fields for a period of not less
than ten years or who has served in a combination of these fields
which in the aggregate is not less than ten years.

It's hard to think the President would just ups and appoint a lay assessor without consultation especially since she is a former Judge: https://otp.tt/the-president/thepresident/

...but it's not impossible for her or her office to blunder.

More is going on in the background for sure but if this goes to the courts, taxpayers footing the bill and Veera will be compensated.

The appointment by the Prez means what?

If the Prez's appointment letter is the defacto instrument then the EO Tribunal(corrected from Commission) has zero discretion.

If the Eo has the Discretion to say 'we dont need you' then the Prez appointment letter mean fkin what?

And why would the Prez appoint a 3rd LA if the Act says 2 LAs??

Commission and Tribunal, though related, are two separate entities. Her grievance is with the EOT.

Based on the act there can only be 2.
Does the 10 year req have to be followed...the act says shall.

If the president appoints and swears in dothey have to hire her?

Can you read what you posted yourself.... the last line says "or who has served in a combination of these fields which in the aggregate is not less than 10 years."

So if you spend 5 years doing social welfare service and 7 years doing Law and 3 years as a religious leader the aggregate is 15 years once all were done simultaneously and even tough you spent no more than 10 years doing any of the 3 individually.... capiche
