Donald Trump has lost the civil case of sexual assault brought against him by E. Jean Carroll, and will now have to pay her $5 million, pending appeal. But did you know that this case could only be brought thanks to a recent amendment to New York statutes pushed by Democrats and Carroll herself and without this legislative “fix” the statute of limitations for the lawsuit would have run out?

Yes. The news coverage of the bill's signing in New York State was huge. There has already been quite a large number of look-back cases that have been fiiled against both individuals and corporations.

IIRC:

There were more than 20 Democratic senators that co-sponsored the bill.

The bill passed the NY senate unanimously.

All but 3 of the 151 votes cast in the NY house were in favor of the bill.

A New York law that temporarily lifts the statute of limitations on civil sexual-abuse and harassment claims has sparked a flurry of activity just two weeks after taking effect — a warning sign for Wall Street banks and other employers that victims from decades earlier are on the hunt for justice.

Hundreds of alleged victims have sought legal advice in recent days and companies are calling outside attorneys to prepare for potential claims, according to interviews with a dozen lawyers from across the US. Lawsuits have already been filed against former President Donald Trump, comedian Bill Cosby and billionaire Leon Black over allegations they assaulted women decades ago, which their lawyers deny.

The claims are tied to the Adult Survivors Act, which took effect Nov. 24 and gives those making accusations of past assaults one year to seek financial compensation from alleged offenders and employers who may have harbored them, no matter how long ago the incident occurred. It aims to fill a gap left by 2019 legislation that extended New York’s statute of limitations on sex-abuse claims to 20 years from just one year, but not retroactively.

Albany, New York – Assemblymember Linda B. Rosenthal (D/WF- New York) today celebrated the New York State Assembly's passage of the Adult Survivor's Act (ASA). Like the Child Victims Act (CVA), the ASA will provide adults who were sexually assaulted with a one-year lookback window within which to bring previously time-barred civil cases. Working with a broad coalition of survivors and advocates, many of whom worked to pass the CVA, Assemblymember Rosenthal introduced the bill in 2019, and has worked to build support among her colleagues in the Assembly. 

"Regardless of your age, sexual assault destroys a piece of you, and it takes most survivors time to process and overcome the unique trauma. More time than New York law currently allows. Today is a watershed moment for survivors of sexual assault. Today, New York says that standing with survivors is more important than shielding individuals and institutions from liability. When the ASA finally becomes law, the doors to justice will be flung wide open and countless survivors will have an opportunity to seize justice by filing a case against their abusers, and the institutions that harbored them, in the civil court.

The long awaited Durham Report is out

A report from Special Counsel John Durham accuses the FBI of a double standard for aggressively probing ties between Russia and Donald Trump’s 2016 presidential campaign while soft-pedaling similar claims about foreigners seeking influence over Democratic candidate Hillary Clinton.

Durham’s long-awaited, 306-page report slams the FBI’s handling of the Trump-Russia probe as deeply flawed. But Durham’s investigation into the origins of that probe resulted in few criminal charges, and the release of his report is unlikely to offset his high-profile failures in court. He charged just three defendants during his four-year investigation; juries quickly acquitted two of them, while a third pleaded guilty and avoided prison time.

“The objective facts show that the FBI’s handling of important aspects of the Crossfire Hurricane matter were seriously deficient,” Durham wrote, referring to the code name for the counterintelligence probe of links between Russian officials and Trump associates.

Durham’s report also bemoaned investigators’ “disparate treatment” of the Trump and Clinton campaigns. The report describes various alleged efforts by foreign governments or individuals to influence Clinton through campaign donations and notes that the Clinton campaign was briefed on some such efforts, while Trump and his aides were not briefed about the FBI’s suspicions regarding his bid.

Durham’s report stops just short of saying that political bias drove the FBI’s decisions, saying that while there was evidence of strong political views on the part of some investigators, the FBI’s handling of the Trump probe exhibited clear “confirmation bias” in favor of a likely plot by the Russians.

Poll: Trump takes big lead over DeSantis among California Republicans


Former President Trump has vaulted back to a substantial lead in California over Florida Gov. Ron DeSantis in the race for the Republican presidential nomination, as the party’s voters brush aside his legal travails, a new poll finds.

Trump has the support of 44% of California’s likely Republican primary voters, while DeSantis was backed by 26%, according to the UC Berkeley Institute of Governmental Studies poll co-sponsored by The Times. That’s a notable reversal of their standings three months ago, when DeSantis led Trump by 8 percentage points among the state’s GOP voters.

The former president’s rise shows his ability to use the media to galvanize the voters most likely to back his third White House bid, said Mark DiCamillo, director of the IGS poll.

Prosecutors ready to ask for Trump indictment on obstruction and Espionage Act charges

The Independent has learned that prosecutors are prepared to ask grand jurors to vote on charges as early as Thursday


The Department of Justice is preparing to ask a Washington, DC grand jury to indict former president Donald Trump for violating the Espionage Act and for obstruction of justice as soon as Thursday, adding further weight to the legal baggage facing Mr Trump as he campaigns for his party’s nomination in next year’s presidential election.

The Independent has learned that prosecutors are ready to ask grand jurors to approve an indictment against Mr Trump for violating a portion of the US criminal code known as Section 793, which prohibits “gathering, transmitting or losing” any “information respecting the national defence”.

The use of Section 793, which does not make reference to classified information, is understood to be a strategic decision by prosecutors that has been made to short-circuit Mr Trump’s ability to claim that he used his authority as president to declassify documents he removed from the White House and kept at his Palm Beach, Florida property long after his term expired on 20 January 2021.

That section of US criminal law is written in a way that could encompass Mr Trump’s conduct even if he was authorised to possess the information as president because it states that anyone who “lawfully having possession of, access to, control over, or being entrusted with any document ...relating to the national defence,” and “willfully communicates, delivers, transmits or causes to be communicated, delivered, or transmitted or attempts to communicate, deliver, transmit or cause to be communicated, delivered or transmitted the same to any person not entitled to receive it, or willfully retains the same and fails to deliver it on demand to the officer or employee of the United States entitled to receive it” can be punished by as many as 10 years in prison.

It is understood that prosecutors intend to ask grand jurors to vote on the indictment on Thursday, but that vote could be delayed as much as a week until the next meeting of the grand jury to allow for a complete presentation of evidence, or to allow investigators to gather more evidence for presentation of necessary.

Donald Trump indicted over classified documents case

Former US President Donald Trump has been indicted over his handling of classified documents after he left the White House.

"I never thought it possible that such a thing could happen to a former President of the United States," he wrote on Truth Social.

It is the second indictment of Mr Trump, who is running to be the Republican Party's candidate for president in 2024.

Details of the indictment are unclear.

The BBC's US partner CBS News reported a source as saying the indictment was linked to the documents case and involved multiple charges.

Other US media, including CNN and ABC News, said the indictment involved at least seven charges.

An indictment enables the prosecution of a suspect for offences they are charged with.

The BBC has tried to contact the Department for Justice, which has not released any details of an indictment.

In his Truth Social post, Mr Trump said he was innocent, adding: "This is indeed a dark day for the United States of America. We are a country in serious and rapid decline, but together we will Make America Great Again!"

Mr Trump became the first former president to be charged with a crime in April, after he pleaded not guilty to 34 counts of falsifying business records over a hush-money payment to a porn star.

He faces a trial in that case in New York next year.

There was a story of where they tried to destroy the recorded evidence too of them moving the boxes before the FBI raid.

A Mar-A-Lago employee flooded the room where security footage was stored while draining the resort pool last October, CNN reported Monday—an incident that raised suspicions among Justice Department investigators who are nearing the conclusion of their investigation into former President Trump’s handling of classified documents.

Trump faces a maximum of 400 years in prison and a $9M fine over federal indictment

The 49-page indictment against former President Donald Trump unsealed on Friday revealed that the ex-commander in chief potentially faces hundreds of years behind bars and millions in fines for his alleged mishandling of classified documents.

The 76-year-old has been accused by special counsel Jack Smith of violating seven different federal laws among the 37 separate charges in the indictment.

There are numerous sentencing possibilities, but if Trump is handed the maximum penalty for each count and the judge orders the penalties to be served consecutively, he would be looking at 400 years in prison and would be subject to a fine of $9,250,000.

Nearly half of Americans believe charges against Trump are politicaly motivated


The popularity of Donald Trump rose among Americans despite him becoming the first president to be indicted twice, while Joe Biden’s favourability marked a decline, according to a latest poll

The poll suggested that the ex-president was consolidating more and more support from the people who believe his federal indictment was politically motivated at a time when he is running for the White House and is considered as the front-runner for the 2024 GOP presidential nomination.

Mr Trump emerged as the favourable choice of 31 per cent of people, marking a six per cent rise from April, a poll by ABC News and Ipsos conducted after his second indictment suggested.

Mr Biden’s popularity was tied with Mr Trump, with 31 per cent of people finding him a favourable choice.

His ratings marked a decline of three per cent, hitting an all time low since 2020, in what was the worst indication for the president who launched his re-election bid for 2024 elections.

Donald Trump is 'toast' if indictment correct, William Barr says

William Barr, the former US attorney general who served under Donald Trump, has said the ex-president is "toast" if allegations he mishandled classified documents are proven to be true.

Mr Barr criticised his former boss and said he had no right to keep the files allegedly found at his home.

"I was shocked by the degree of sensitivity of these documents and how many there were... and I think the counts under the Espionage Act that he wilfully retained those documents are solid counts," he said.

"If even half of it is true, then he's toast. It's a very detailed indictment and it's very damning."

Embrace it and be happy.. my foreign peeps saw better business and I was fortunate for better experiences under the orange boss with respect to companies and training for my business.

Working blue collar class saw rewards, pencil pushers are the anti trump complainers…


Plus I like his restaurant’s food a lot in ny.
