Sat torches ex-PM’s legacy

General secretary of the Sanatan Dharma Maha Sabha (SDMS), Sat Maharaj, yesterday launched an extraordinary verbal attack on former prime minister Patrick Manning, describing him as a “racist.”

In a harsh assessment totally out of step with laudatory ones heaped on Manning in the week between his death and his burial, Maharaj said he and several members of the public came to that conclusion on a talk show programme on Radio Jaagriti on Tuesday, based on a series of discriminatory practices Manning perpetuated against Indians in T&T while he served as PM.

In retrospect, Maharaj said he felt “hurt” that many of Manning’s actions were “racist”, unfair and biased against a number of Indians in the country.

“I only spoke about the facts. What I spoke about was his performance as prime minister. I started off by discussing the many discriminatory things he did. As prime minister he acted in a discriminatory manner,” Maharaj said in a telephone interview.

Manning, 69, died on July 2 at the San Fernando General Hospital. He had been hospitalised for a lung infection but was subsequently diagnosed with acute myeloid leukaemia, a rare, aggressive cancer of the blood.

The closure of Caroni 1975 Ltd, whose employees were mostly Indians, Maharaj said was one decision Manning made that crippled the lives of thousands of struggling Indians.

“We are now importing sugar while Barbados and Guyana have sugar industries,” he said.

Maharaj said Manning’s attempt to have Sat Sharma removed as Chief Justice for misbehaviour in public office and for having a limited state of emergency around the home of then House Speaker Occah Seapaul were unforgettable instances.

In 2007, Sharma found himself in trouble when he was accused by then Director of Public Prosecutions, Geoffrey Henderson, of attempting to persuade him to drop a murder charge against vascular surgeon Dr Vijay Naraynsingh in 2004.

“He is the first prime minister in the Commonwealth to try to arrest a chief justice."

“He is also the first PM to call a state of emergency so that Seepaul could not preside as a presiding officer and have a cast in vote. He is the only man in the Commonwealth who appointed his wife as a minister in the Cabinet,” Maharaj said.

He drew reference to public servant, Feroza Ramjohn, who instituted legal action in seeking justice for lack of promotional opportunities.

“I could still remember Manning describing Petrotrin as petrosingh because there were too many Indians working there,” Maharaj said.

He said while PNM stalwart and businessman, Louis Lee Sing, had acquired his radio licence with ease “we had to go the Privy Council to get our radio and television licences. We had to threaten them with contempt of court. That was another case of discrimination.”

Church in Guanapo

Maharaj said the fact that Manning started building a multi-million dollar church in Guanapo, Arima, for himself and one-time spiritual adviser Juliana Pena was also discriminatory.

“Not only he built a church for the Christians but he also established the Divine Echoes Orchestra, which was a Christian-oriented music group.”

In 1992, Maharaj said Manning ordered a study by Dr Selwyn Ryan and Dr John La Guerre, which showed that few Indo-Trinidadians were promoted to senior posts in the public service.

“I read what they said about recruitment in the Police Service... that the Indians top when it comes to the written examination but they failed when they did the interview stage. They pointed to the fact that everybody on the interview panel were Afro Trinidadians.

Few grants for Indian events

When asked why he did not raise these matters publicly when Manning was alive, Maharaj said:
“No! I have been raising these issues all the time. We wrote articles about him. We raised it in the courts too.

“But you see now that he is dead they are trying to make him into some idol. Everybody is painting him as a paragon of virtue... they are ignoring the other side of him.

“They are trying to paint him as some kind of father of the nation when in actual fact he was not. We want to point out the bad side of him.”

Maharaj said many callers concurred with him that what Manning did was discriminatory and wrong. Didn’t the SDMS benefit under Manning’s administration?

“In what way? If you talking about benefits then we are talking about equality. Yes, we benefit... we can use the roads if it is paved,” he answered.

Questioned if the SDMS was the recipient of grants under Manning’s regime for Divali, Phagwa and other religious events, Maharaj said they received “very little grants.”

Told he could face stinging condemnation and backlash for his criticisms against Manning, Maharaj said: “I said it. I don’t care about the backlash.” He said he shared a cordial relationship with Manning and had in fact pointed out to him where he had gone wrong as PM.

Forde response
General secretary of the People’s National Movement Ashton Forde last night expressed astonishment at Maharaj’s comments.

“Any one body who is saying that about Mr Manning is not living in Trinidad and Tobago. They are trying to re-write history”, Forde told the T&T Guardian.

Forde said Manning followed in the footsteps of two great prime ministers- the late Dr Eric Williams and George Chambers’ in ensuring there was equity in the governance of the country.

“Many of the country’s high commissioners, Cabinet ministers and directors on State boards who served under Mr Manning were Indian. Mr Manning embraced all races. He did not discriminate at all. I knew him personally. He was a fair man.”

Forde said people who were appointed under the People’s Partnership government also credited Manning for his work and fairplay.

It seems that your opinion is only "correct" if it aligns with the masses. Sat saw him that way, so Sat like any of us, is free to express his opinion. Is it disrespectful? Is it too soon? Does it change some of the issues that Sat spoke about? If you've read "The Quiet American" by Graham Greene, you'd get an insight into what I believe his character was, a generally well intentioned man who lost his way, and who was so convinced that he knew what was good for us, that he brooked absolutely no divergent opinions. That ultimately led to his downfall.

I agree. As for not speaking ill of the dead... I agree with everything that Sat Maraj said. Facts is fact. I not comparing him to what was done under Panday or Kamla, as they have their own burdens and fiascoes to bear.

The London-based Privy Council ruled yesterday that the name of the Trinity Cross, the nation’s highest award, was unconstitutional. The Law Lords said it would be unfair to make the order retroactive, so the holders of the nation’s highest award would not be affected by the judgment. Between 1969 and 2002, 64 people and/or groups, were awarded the Trinity Cross.

The London-based Privy Council ruled yesterday that the name of the Trinity Cross, the nation’s highest award, was unconstitutional. The Law Lords said it would be unfair to make the order retroactive, so the holders of the nation’s highest award would not be affected by the judgment. Between 1969 and 2002, 64 people and/or groups, were awarded the Trinity Cross.

In a 20-page judgment delivered yesterday, the Privy Council ruled in favour of the Sanatan Dharma Maha Sabha and its general secretary Sat Maharaj, the Islamic Relief Centre and social activist Inshan Ishmael. The Law Lords reversed the decisions of both the local High Court and Court of Appeal, which had refused to declare the Trinity Cross illegal, even though it found that it was discriminatory.

The judgment was delivered by Lord Hope, sitting with Baroness Hale and Lords Carswell, Brown, and Mance. The Maha Sabha was represented by Sir Fenton Ramsahoye, SC, and Anand Ramlogan, while British Queen’s Counsel, Paul Newman, represented the Islamic Relief Centre and Ishmael. James Dinglemans, QC, and John Almeida, appeared for the Attorney General. The Privy Council, in the judgment, said the local court fell into error when it held that the court had no power to declare the Trinity Cross unconstitutional because it had pre-dated the constitution itself and was expressly preserved.

The law lords said the Trinity Cross was inconsistent with the constitutional right to equality from day one and hence could not be saved by the Independence constitution. It was an infringement of the rights and freedoms of members of the Hindu and Muslim communities and was therefore unconstitutional, the Law Lords ruled. The Privy Council granted three declarations in favour of the Maha Sabha: the creation of the Trinity Cross breached their right to equality, their right to equality of treatment, and their right to freedom of conscience and belief.

From August 26, 1969, the Trinity Cross was established to honour citizens of T&T who had rendered distinguished or meritorious service, or for gallantry. In February 1997, the National Awards Committee was asked the examine the awards system. It was acknowledged that the highest award had attracted negative criticism, especially as the words “trinity” and “cross” were perceived by many to be Christian expressions.

On November 16, 2004, the appellants filed a constitutional motion in the High Court, seeking, among other things, a declaration that the Trinity Cross was discriminatory against them and others who were not Christians. On May 26, 2006, Justice Peter Jamadar held that the Trinity Cross was discriminatory, but he did not deem it unconstitutional. Before the Court of Appeal, the State did not challenge the trial judge’s findings that the award of the Trinity Cross infringed sections 4 (b) (d) and (h) of the constitution. The appellants went to the Privy Council, seeking a declaration that the Trinity Cross was illegal.

Trinidad Hindus Win 7 Year Legal Battle
By Devant Maharaj, An Executive Member of the Sanatan Dharma Maha Sabha


In 1999 the Sanatan Dharma Maha Sabha Inc. of Trinidad and Tobago [SDMS]
applied to the government of Trinidad and Tobago for a radio frequency for
the expressed purpose of broadcasting Hindu programming. The Indian-led
party with the Hindu Prime Minister informed the SDMS that they should apply
under a company and not the religious organization as then the State will be
then obliged to all religious organizations. The SDMS complied and then
waited for the application to be processed.


In 2001 there was a General Elections in the twin island Caribbean nation
just 10 miles off the coast of Venezuela and the South American continent.
The victorious African led and Christian dominated party shortly winning
awarded one of its party financiers a radio frequency. The supporter had no
application made to the government and the company awarded the frequency was
not even legally registered. The SDMS cried foul and subsequently took the
matter to court.


In February 2004, the SDMS won its discrimination case against the State.
Justice Carlton Best, presiding at San Fernando High Court, ruled that the
organisation was treated unequally when Cabinet bypassed its application and
awarded a broadcast licence to PNM supporter Louis Lee Sing. In his ruling,
Best said the Maha Sabha had been denied equality of treatment before the
law by the State. The SDMS was awarded redress and costs for senior and
junior counsel. However, the judge stated there was no need to declare that
the SDMS had been denied freedom of expression. Best also declined to give a
court order directing Cabinet to grant the Maha Sabha a licence. The State,
represented by former Attorney General Russell Martineau SC, filed an appeal
against Best's decision.


At the October 2004 appeal Satnarayan Maharaj, head of the Sanatan Dharma
Maha Sabha (SDMS), said yesterday that he was looking forward to taking his
organisations fight for a radio licence to the Privy Council. He said this
even before judgment on the case was delivered by the Court of Appeal. "I am
hoping that the Court of Appeal will respond favourably to our arguments,
but we know that there is another step in this journey for equality and it
is at the Privy Council in London," Maharaj stated.


In January 2005 Cabinet has been ordered to consider the Sanatan Dharma Maha
Sabha's application for a radio licence. However, almost a year after the
religious body won its discrimination case against the State, it failed
yesterday to convince the Appeal Court to order that a licence be awarded.
Instead, in an unanimous decision, Justices of Appeal Roger Hamel-Smith,
Margot Warner and Allan Mendonca directed that the Maha Sabha's application
be placed before Cabinet within 28 days for its consideration. "I would
think that Cabinet is to be trusted to act responsibly and fairly in
determining whether or not a licence should be granted to the appellants.
"There is nothing to suggest that there is a risk that the application will
not be successful," Hamel-Smith said in one of three unanimous judgements
delivered in the case. But in an immediate response, the religious body said
if the Cabinet did not grant the licence, it would petition the Privy
Council, saying that would be "even further evidence of discrimination by
the State."


The Maha Sabha was also unsuccessful, last year, in asking the High Court to
order that it be granted a licence. The body's secretary general, Satnarayan
Maharaj, is in India. Also in a statement yesterday, Attorney General John
Jeremie said Government was reviewing the judgement. "But (we) remain
committed to the rule of law and deeply respectful of the decision of the
courts." The appealed the matter to the Judicial Committee of the Privy
Council in London as it continued to the deny the Caribbean's largest Hindu
organization.


On July 4th 2006 The Sanatan Dharma Maha Sabha was victorious in its appeal
to the Privy Council against the government because of its consistent
refusal to award the organization a radio licence. In a landmark 19-page
judgment Lord Mance said 'in light of the exceptional circumstances' of the
discrimination the Privy Council would order Attorney General John Jeremie
to do all that is necessary to ensure that a licence is issued forthwith to
the Hindu organization. The State was also ordered to pay the Maha Sabha's
legal costs in all the courts.


The judgment was a unanimous one as the other law lords agreed with the
judgment delivered by Lord Mance. The other law lords were Lords Hoffman,
Hope, Hutton and Brown. In addition to confirming the finding of
discrimination, the court also held that the Maha Sabha's constitutional
right to freedom of expression was also violated. It found that there had
been a conspicuous failure to deal with the Maha Sabha's application for
over three years and ruled that there was 'unexplained and unjustified
discrimination in favour of Louis Lee Sing's Citadel.'


The court noted that the Maha Sabha's application had been approved since
the 1st September 2000 and found that no explanation was given for the
sudden award of a radio licence to Louis Lee Sing's Citadel Limited which
now operates the I 95 radio frequency. Former Minister of Science and
Technology Hedwidge Bereaux told a media conference that Citadel had applied
for its licence on March 13th 2001 but the law lord said this could not be
correct because the Companies Register showed that Citadel was only
incorporated on the 28th August 2001 shortly before the last general
election after the 18/18 tie.


The court cited a letter dated 18th July 2002 by Permanent Secretary
Emmanuel George to Lee Sing, describing it as 'a vigorous request' for an
explanation from Lee Sing as to why he was applying for a new radio station
when it was clear that he was already operating 92.5 FM. This frequency, as
Mr George had noted, was not given to Lee Sing, but Trinidad Broadcasting
Systems Limited. The law lord noted that no explanation was given by Lee
Sing but he was nevertheless granted a new licence by the government.
The Court of Appeal had ordered the government to consider the Maha Sabha's
application within 28 days however, by letter dated 17th May 2005 the Maha
Sabha was informed, for the first time, that Cabinet had long considered and
refused its application since June 21st 2004 on the ground that it was
incomplete.


The Privy Council described this as 'remarkable' and said that the failure
to disclose this fact misled the Court of Appeal which proceeded to hear the
case 'on a false premise'. The court said "The letter discloses a situation
in which the Court of Appeal was allowed to proceed under a serious
misapprehension in and throughout the course of two substantial hearings.
The Court of Appeal was twice allowed to give judgment on false premises
viz, that Cabinet had never considered the application, still less reached
any decision on it prior to the Court of Appeal's first judgment'.
The court commented that no explanation was given as to why the State
concealed these facts from the Court of Appeal 'although it is obvious that
one would be expected'. The State's lawyer described the position as
'unusual and unsatisfactory' but the Privy Council said this was 'an
understatement'.


The Maha Sabha was represented by Sir Fenton Ramsahoye SC and Anand
Ramlogan. The State was represented by Russel Martineau SC in the Appeal
Court and Peter Knox QC in the Privy Council.


Despite this ruling the State up to September 2006 refused to implement the
judgement and award the radio frequency and as such The Sanatan Dharma Maha
Sabha Inc. issued a strongly worded letter to the Attorney General, John
Jeremy, accusing him of demonstrating contempt for the judgment of the
highest court of the land - the Judicial Committee of the Privy Council. As
a result of this threat on Friday 23rd September 2006 THE Sanatan Dharma
Maha Sabha's six-year wait for a radio broadcast licence ended when its
secretary-general Sat Maharaj signed the relevant documents to grant it a
radio licence at the Telecom Authority's offices in San Juan.


The new Maha Sabha radio station will be called Radio Jaagriti (Awakening),
will be based in Tunapuna and be operational by November 1. Maharaj said it
was unfortunate that this kind of treatment could be meted out to anyone in
a democracy like TT. He hoped that no individual or group in TT would ever
have to endure the Maha Sabha's "torture" and that Government would never
allow this situation to repeat itself.


The Maha Sabha will along with the Radio Station also be operating a Cable
Television station making it the first Hindu broadcasting network in the
Southern Hemisphere as well as the Western Hemisphere.

This ...... Sat is the equivalent of any random person in the rum shop or by the doubles stand. They're free to have an opinion but no one should really care. I'm yet to have a clear understanding of who he represents or who are his supporters.
If Sat thinks the man was racist it's fine by me , he's entitled to his opinion and people are entitled to disagree.

Maybe its valuable to assess what the truth is.

Who had the more racially diverse support base.?
One has to assume that your support base is a result of your efforts and represents your target market.

So if we talking RACE-then the reality is that Sat s target market is less diverse,and more inclined to have race as a higher priority.
And who holding his office through fiat vs elections.???

There are more decisions by the Privy council against the Former PMs decisions that against Sat....so Sat/detractors will always have that to harp on...

Sat Right on every account, but it not all Manning to blame. Manning takes advice from the PNM.

It's the PNM that is racist and the people within that party. Juss how we have the Minster of National security advising to get rid of Indians in the SSA it's the same in every PNM held institution.

Only non Racist PMs we ever had was Chambers, Panday and Kamla.

The truth is that he was unfairly and maliciously denied a broadcasting licence. Matters not what target audience, or support base is aimed at. It also doesn't matter how he holds on to his post. If the membership of the Maha Sabha is happy with that process, then they are entitled to have him there as long as they want. The PNM Government even after being ordered by the Privy Council, :shock: refused to grant him the licence. Worst yet, he was not told that his application had been denied YEARS before! If that doesn't hint at racism, then I don't know what qualifies.

Racism or religious bias?

There are Muslims of East Indian descent too. Were they also denied broadcast licenses? If not? Then how can it be racism?

how come if the late Manning was racist:

- he said in public forum that all governments were racist, and people south fo the caroni river deserved more of all resrouces?

- allegations of saying no afro chirren in his schools

- he never want he daugther to marry no afro man.

- it proven that black people have less intelligent and more prone to violence.
