$200 million fraud claim: State goes after Moonilal, 'cartel' contractors

THE State is soon to start legal action against former Government minister Dr Roodal Moonilal over allegations of bid rigging with respect to some ten contracts through the Estate Management and Business Development Company (EMBD) in 2015.

Minister in the Office of the Attorney General Stuart Young disclosed yesterday that Government has also, through the Estate Management and Business Development Company (EMBD), filed claims in the court against five contractors for alleged “cartel” arrangements and attempts to defraud.

Those claims were filed last Thursday.

The contractors - TN Ramnauth and Company Limited, Mootilal Ramhit and Sons Contracting Limited, Kallco Company Limited (Kallco), Namalco Construction Services Limited (Namalco) and Fides Limited (Fides) – have, according to Young, been found to have colluded to defraud the State of over $200 million through bid-rigging and contracts with inflated costs.

The work for which the money was paid was mostly the upgrading of traces and roads of former Caroni (1975) Ltd lands, which Young said was examined over the last 18 months and to be mostly of “no value” and “worthless”.

The State's action will include claims against former chief executive officer of the EMBD, Gary Parmassar, who was in 2016 among officials of that company sent on administrative leave, pending a financial audit into the awarding of $400 million worth of contracts through the State-owned company.

Young said Government's “best in school” forensic team has found evidence of collusion, mostly via text messages, among Moonilal, the contractors and the EMBD official.

Young said there is also evidence that the five contractors were “hand-picked” for the upgrade and rehabilitation of certain Caroni Roads.

Four of the contractors, Namalco, TN Ramnauth, Kallco and Ramhit, last year commenced legal action against EMBD for recovery of monies that they allege are owed to them, including a Namalco claim in May 2016 for over $1 billion.

The claims were yesterday stayed in the High Court and while Young could not when the test of the State's action will hit the court, he said he hoped it would be “soon”.

“As a result of the work conducted, evidence has been unearthed, based on forensic work, an analysis of actual work done versus what was claimed to be done, an analysis of the tenders submitted by the contractors and following the money, which supports a conclusion of bid-rigging and cartel behaviour amongst these 5 contractors, supported and/ or encouraged and/

or permitted by persons in public office, including the former Minister of Housing, Dr Roodal Moonilal, who at all material times was the line Minister for EMBD,” Young stated at a press conference yesterday at the Office of the Attorney General and Legal Affairs.

The forensic work, according to Young, included text messages from the phone number registered to Moonilal, instructing Parmassar to prepare cheques for tens of millions of dollars to these contractors and to bring the cheques to him, as the former Housing Minister minister, once prepared.

They also show Mr Taradauth Ramnauth organising a HDC house for Mr Gary Parmassar, telling him who to award contacts from EMBD to and how much to pay these identified contractors, Young said.

Real lolz with this issue...id start with the govt claiming one company riding hard with moonilal but on the other hand they just award that same company a big contract...

Govt need to come good with evidence

Just to clarify something for the naive in here. There are no PNM contractors and UNC contractors. Contractors on the whole play both sides.

Shortly after winning elections, the "fab four" contractors under the UNC met with a senior PNM official at one of his satellite offices. All of a sudden, the UNC "fab four" contractors are winning contracts under the PNM.

All this talk from UNC and PNM politicians about someone making a jail is a bunch of nonsense. They both protect each other and their financiers.

What would make interesting reading is the tender evaluation report for the highway contract recently awarded to Kall Company Limited. Someone should request a copy of it from NIDCO under the Freedom of Information Act.

This is a civil case and not criminal so the state looking for money, not necessarily to jail anyone.

As with Anand Ramlogan, this will take years and may go all the way to the privy council.

So this little imps don't need to go before no court! Like his boss JUHN Scarfy, and his boyfriend Arse-Wari, he arrogates unto himself the role of judge, jury and executioner. What this dotish little neophyte should tell us why his BFF still there as AG when no less than TWO criminal complaints have been filed against him, as well as IC probes into the children at Cumuto, who this kant still will not acknowledge to this day btw.

Anyone remember the Sunshine photo taken in Millinieum lakes from 2015 with Sagar (fides), kalloo, ramhit and Tim Gopeeesingh with the brown paper bag?? Just a typical Sunday brunch!!! Me thinks Roodal is just the tip of an iceberg.

Yuh trying to stink up Gopeesingh name, the brown bag had some lunch which was packed for him, he said so himself. He was only there to eat ah food. Anyway , Ramhit has no case to answer , he died two months ago. Sagar and his father are big lawyers , and Rohani family safe .

I thought Allyuh say Kamla made the AV public....So now KPB doing the distracting.
AV investigation started last year...the results were delivered weeks before KPB distracted us.

Moonilal and Co will have their day in court.Well he look like he have many days in court to face.

Well done AG.....now follow through with the procurement legislation and perfect it by implementing all dem recommendations from COEs past.

Don't just persecute your opponent s....protect the public interest.

Nothing will come out of this, however if Moonilal does make ah jail it will only help the UNC.

If Moonilal and the Cabal get lock up and Kamla is forced to step down as leader then the PNM is done for in 2020 and Rowley knows this. He wants Moonilal, Coonilal and Toonilal along with Kamla at the helm of the UNC the rum drinker and the nasty cabal is the reason we are in this position today. But UNC people can't see this for some reason

This situation with Moonilal has been going on for some months Rowley hinted about it before heading to the US for his check up and the Facebook UNC group loyalist erupted about how Rowley controlling the police. There is no smoke screen. If it was then u would also be calling the PNM member who was suspended recently pending investigation a smoke screen too. Based on what has been published so far it does not appear that any criminal criminal charges have been levied against the contractors nor Moonilal. Its all civil claims.
It still does not appear that there is either the willpower or the competency in the local policing and judiciary system to actually arrest and prosecute white collar criminals apart from the odd tax evader.

How come due process for the PNM seems to only involve political opponents? When they start with their own, I'll believe that they are serious, not this "bag ah talk" from Scarfy. Harry Ragoonanan take a fall for the simple reason of PNM big boys trying to look impartial. Let's see what happens to him eventually.

Didn't Eric Williams Jr *take a fall* also who are the corrupt within the party/cabinet provide your info to the relevant authorities or go to the media let them uncover the web of deceit. Otherwise everyone is innocent until proven guilty which includes Moonilal.
