Edmund Dillon found guilty of fraud --- ordered by a US Supreme court to repay every cent stolen

National Security Minister Edmund Dillon who was answering charges of fraud in a US Supreme court, has been found guilty as charged and ordered to pay back every cent to 88-year-old Nevill Piper who is also disabled and is wheelchair bound.

Last Thursday, minister Dillon cracked an April's fools joke and told the media the matter was frivolous and he was confident the matter will be thrown out on April 4th. Well the US Supreme court was having none of that; all documents provided to the New York court proved that national security minister Dillon, stole thousands of US dollars from the bank account of Neville Piper.

All eyes on prime minister Keith Rowley, now that his national security minister has been charged in a US Supreme court for fraud.

Should the prime minister have waited for the outcome of this matter before firing his national security minister?

ON the 11 th October 2017 the account at Oppenheimer was closed and a whopping US $ 459,504.49 equivalent to about 3.5 million TT withdrawn ...

US$62,000.00 was withdrawn from the Citibank insured money market account ..

Furthermore a sum of ...US $ 50,000 was paid to Ernest Wilson ..which Wilson hurriedly returned when the court revoked the power of attorney .....

There are many more bank accounts which they apparently intended to to raid...but were stopped dead in their tracks when the court revoked the power of attorney and froze the assets which they had withdrawn

Pearce Robinson -these are serious allegations of fraudulent misconduct and until it is fully ventilated and he is cleared, he ought to be placed on immediate "Time Out".“

Pearce Robinson - A country's national security minister cannot have such serious allegations of fraud swirling over his head. He needs to temporarily be made to step down pending the outcome of the court matter.

These allegations are just simply too serious for a Minister of National Security and one would expect (maybe not firing) but the Minister taking an immediate leave of absence pending the outcome.

The fact that he admitted to being in receipt of a property that is in contention is quite enough.

Restraining order issued against Trinidad national security minister by New York court

NEW YORK, USA — Trinidad and Tobago’s national security minister, Edmund Dillon, was on Thursday ordered by the New York Supreme Court to stop any transactions related to the accounts and properties of an elderly and incapacitated man in Manhattan, New York, whom Dillon claims signed over access to his properties along with banking account details.

Dillon, who was in court as the petition was filed by, and granted to a family member of the alleged victim, Neville Piper, has been back and forth to New York over the course of the last several weeks in an attempt to answer the fraud related charges and to address the court.

The petitioner, Esther Nicholls, as a result of the recent court order, has been awarded temporary custody and guardianship of Piper until the matter is resolved.

It is alleged that Dillon illegally transferred ownership of a New York condominium said to be the property of Piper.

Piper’s lawyers and the petitioner allege that Piper, who now lives in a retirement village, has no recollection of ever signing ownership over to Dillon at any time and does not recognize Dillon as being anyone he would have done business with. In addition, Piper alleges that the signatures on the reported transfer of property in the condominium are not his own and are forged.

The court documents also indicate that a follow up visit to examine the health and soundness of Piper found him to be wheelchair bound, but in possession of his mental faculties and astute in his observations and accounts of his last few months.

It is also alleged that between August 2017 up to October 2017, after which initial motions against Dillon were first filed, Dillon and his attorney, Ernest Wilson, transferred a total of over US$500,000 from Piper’s accounts, with some of the withdrawals allegedly being deposited to accounts owned by Dillon and Wilson.

The presiding Judge Laura Visitacion-Lewis has ordered that Dillon be enjoined, restrained and prohibited from transferring any interest in the New York condominium owned by Piper until the court case is finalised and a verdict is reached.

Judge Visitacion-Lewis also ordered that Dillon and Wilson are enjoined, restrained and prohibited from transferring, secreting or disposing of any monies and/or assets owned by Piper until the court case is finalised and a verdict is reached.

If found guilty of the charges of fraud, the amount is more than US$50,000 but less than a million, which classifies it as C class felony, and Dillon can face anywhere between five and 15 years in prison on each count; and between one to three years on each count less than UD$50,000.

Dillon’s next court date is scheduled for April 24, 2018.

if I understand correctly, it's not just a private civil matter. I believe that at least one of those incidents would be a criminal matter & punishable by prison time upon being found culpable.

If Uncle Sam say he want Rowley to waive any & all diplomatic immunity that Dillon may have as a minister, or if they request to have Dillon extradited, would he comply? MINISTER OF NATIONAL SECURITY CLARIFIES INFORMATION SURROUNDING CIVIL COURT MATTER

March 26, 2018

On Friday, March 23, 2018, I held a press conference at the Ministry of National Security in Port of Spain, to clarify and correct earlier reports in the media about a Civil Court matter in the courts in New York.

Despite this effort, there have been several erroneous and libelous statements being levelled against me regarding these civil proceedings.

I wish to categorically reiterate that I have not been charged nor am I presently charged in any matter.

I have done absolutely nothing wrong. The court has not yet commenced any enquiry into any wrong doing, much less arrived at any decision or judgment of any wrong doing on my part.

Let me reiterate for the record: Allegations have been made against me in a Civil Matter wherein I am not a party. Contrary to salacious and erroneous media reports, I am not involved in any criminal court indictment, and there has been no conviction of any kind against me.

I would like to caution the media that it must be responsible in its reporting. More importantly, I urge the population to resist any attempt by those intent on making mischief and bringing my good name into disrepute.

This is a clear case of maliciousness perpetuated by those with an intent on publishing innuendos and uncorroborated facts. I wish to advise all such individuals that this is highly libelous and they should be guided accordingly.

The matter is taking its normal course through the New York State court system.

See below a Statement of Facts from my attorney:

1. On September 11th 2017, Esther Nichols brought a proceeding in the Supreme Court, of the State of New York, pursuant to Article 81, of the New York Mental Hygiene Law, for the appointment of a Guardian for her uncle, Mr. Neville B. Piper, an alleged incapacitated person.

2. Edmund Dillon, was not named as a party in this proceeding, and no allegations were made in this proceeding adverse to Edmund Dillon. Mr. Dillon and Mr. Piper were long-time friends for over 45 years.

3 At the December 4th 2017 initial court appearance of Ms Nichol’s guardianship, the Court appointed Reginald Asiedu Esq., as interim temporary guardian of the person and property of Mr. Piper.

4. On February 30th 2018, Asiedu Esq., as interim temporary guardian of the property of Mr. Neville Piper, commenced a turnover proceeding, alleging, without any evidence whatsoever, fraudulent deed transfer, and misappropriation of funds against Mr. Dillon, despite the fact that Mr. Dillon has not been named as a party to the Article 81 Proceeding.

5. Mr. Piper on August 12th 2017, transferred an undivided half interest of his property located in Manhattan New York to Mr. Dillon. This deed transfer was done willingly, and the transfer documents, were executed by Mr. Piper, in the presence of counsel, and in the presence of an independent witness. Both Mr. Piper and Mr. Dillon's signature on the deed, were notarized. Pursuant to New York CPLR 4538, certification of acknowledgment or proof of a writing, in a manner prescribed by law for taking and certifying the acknowledgment or proof of a conveyance of real property within the state of New York is prima facie evidence that it was executed by the person who purported to do so, in this case Mr. Neville Piper. Thus the certification of acknowledgment attached, to the instrument in question, raises the presumption of due execution.

7. The allegations against Mr. Dillon, made by the temporary (now permanent) guardian Reginald Adiedu Esq., are totally bereft of any factual data. Furthermore the Court has not yet conducted a trial/hearing on the merits to determine the veracity of the allegations in the guardian’s petition.

8. This determination can only be made after a trial/hearing on the merits of the claims and allegations of the guardian.

9. This matter is currently before the State Supreme Civil Court, and there is a scheduled court appearance on April 4th 2018.

10. The media reports that Mr. Dillon has been indicted and/or convicted of a criminal offence, are totally and absolutely incorrect. The matter is currently in Supreme Civil Court New York County.

When it comes to elderly people that have children/progeny that ignore them until there are assets to share up....anything is possible...

So its possible that Dillion try a ting-and getting caught....it is also possible that he didnt do anything wrong and the niece is making an end run for the assets....now that they know that the man has assets-they love him....
