Mr Gear challenges CoP & T. C. over Tint Pg. 5

Yes folks, your not so friendly citizen's advocate is set to throw down against the Commissioner of Police and the Transport Commissioner this Thursday over their misinterpretation of the laws governing tint.

So get your MV & RTA handy because these lessons are gonna hit them hard and may even hit them where it hurts - their pockets !

The majority of Private Motor Vehicles are immune from the so called tint laws...stay tuned.

Those of you who know me will know that i don't back and I don't lose either.

we i for one pledging my support for the sassman ,

23. (1) (d) no motor vehicle the windscreen or any other win­dow of which is fitted with glass so tinted, treated or darkened as to obscure the view of the inside of the vehicle from the outside;

this is subject to too much interpretation and no officer should be making any informed person remove their tint on this "view"

By the way. I have not been targeted to remove any tint and I am at no risk of being asked to remove tint.

I am just asking that the true law be used. I don't like it when arbitrary interpretation of the law are used to oppress our citizens.

The law is never set in stone. Laws are meant to be interpreted, biases and hypocrisy aside. You will lose.

They'll claim that they can use a purposive approach to the law...

What exactly is "true law"? Moreover you've decided to become the V for Vendetta in your country because YOU do not like the interpretation of said legislation? Your argument is incorrectly premised on seeing consistency. The law is obscure and as such so will be the actions of those enforcing the law. Game. Set. Match. Goodbye.

That is the whole point of the argument. That they should not use a Purposive approach. Rather Textualism, since the whole issue is so loosely defined in the MVA. They can not define the Intention of the Tint related Sections in the MVA. A purposive approach is not acceptable here.

[b]rodfarva[/], who should assume the responsibility of not only promulgating but making law? Even under a textualist guise, interpretation by one or more legislators of the text is still applied. Predilections of what the law ought to be will ultimately influence the legislator's interpretation of what the law is.

...Because they cannot define that intention of the tint in the MVA they're gonna say that the law makers could not possibly have intended that cars with dark tints get away because of crime blah blah blah whatever reasons they pull out, hence teleological approach will be very much welcomed

We get your opinion an everythin but the man has taken on a similar situation as regards to sticker number plates an came out on top, it very much the same as the law as regards to number plates are left up to the individual officer's interpretation, an had no clear definition of what a plate shud be. Same applies here, but its the effort from him that is appreciated more than the indiviual outcome. Sayin the man will lose from the get go is jus an ignorant "i give up" attitude
