Lawsuit over highway construction

A legal challenge has been mounted against Government’s proposed Churchill Roosevelt Highway Extension to Manzanilla.

Environmental lobby Fishermen and Friends of the Sea (FFOS) is seeking to have the courts review a decision by the Environmental Management Authority (EMA) to issue a certificate of environmental clearance (CEC) to the Ministry of Works, for construction of a 5,000 metre highway starting at the Cumuto Main Road and ending at Guaico Trace in Sangre Grande.

In its lawsuit, FFOS contends the CEC is “unreasonable, illegal, procedurally improper, irrational, null and void and of no effect.” As part of their judicial review claim, FFOS is also asking the court for an interim injunction to stop all expenditure and construction work on the project.

The Ministry of Works and Transport has intervened in the matter as an interested party. At yesterday’s hearing before Justice Kevin Ramcharan, in the Port of Spain High Court, a legal representative from the EMA said the authority was resisting the application filed by FFOS but is in the process of retaining legal counsel.

Senior State Counsel Josephina Baptiste-Mohammed, who appeared for the Ministry, submitted there was no need for an urgent hearing since it is not expected that any work on the highway project will begin for at least six weeks. She said the contract between the National Infrastructure Development Company Limited (Nidco) and the contractor selected for the project, has not yet been signed and there is a baseline survey to be completed and an environmental management plan before the EMA for approval.

“I suggest we revisit the issue in six weeks or so,” she said. In the end, the parties agreed to have the trial adjourned to November 2, to be heard in the San Fernando High Court.

CEC approval fraudulent?

The environmental lobby Fisherman and Friends of the Sea(FFSO) has challenged the Environmental Management Authority's(EMA) decision to issue a certificate of clearance or CEC to the Ministry of Works and NIDCO for the construction of a five thousand metre highway starting at Cumuto Main Road and ending at Guaico Trace Sangre Grande.

While the matter is still engaging the court's attention, TV6 News obtained documents showing that the technical team of the EMA had raised strong objections in granting a CEC for the project back in June.

Lobbyist group seeks to stop work on Manzanilla highway extension

Environmental lobbyist group Fishermen and Friends of the Sea (FFOS) is seeking to stop work which has started on the Churchill Roosevelt Highway extension to Manzanilla.

The group says the preparatory works near the Aripo Savannas. part of Phase 1 of the project. began on January 8, and already heavy machinery has begun bulldozing the southern boundary of the Aripo Savannas and the standing forests, including the Moriche palms, which are within the designated Long Stretch Forest Reserve.

FFOS secretary Gary Aboud said the work threatens the protected Aripo Savannas which are an environmentally sensitive area (ESA).

Hearing of the injunction application takes place today at the Hall of Justice in Port of Spain before Justice David Harris.

The group has also challenged the decision by the Environmental Management Authority (EMA) to issue a certificate of environmental clearance (CEC) to the Ministry of Works for a 5,000-metre highway from the Cumuto Main Road to Guaico Trace in Sangre Grande.

In its lawsuit, FFOS contends the CEC is “unreasonable, illegal, procedurally improper, irrational, null and void and of no effect.”

This is being heard before another judge.

Aripo Savannas
The significance of Aripo Savannas and its biodiversity has been recognised for many years as part of the larger Long Stretch Forest Reserve declared in 1934, as a proposed Scientific Reserve in 1980, and as a Prohibited Area in 1987. The Aripo Savannas is also internationally renowned for its unusual flora in striking vegetation communities. It is one of the more intensively studied areas of natural ecosystems in Trinidad.

Through the Environmentally Sensitive Areas Rules, 2001 (ESA Rules 2001), the Environmental Management Authority (EMA) has been declaring terrestrial and marine areas of Trinidad and Tobago to be protected according to criteria set out in the ESA Rules. The ESA Rules were made under Sections 41, 42 and 43 of the Environmental Management Act, 2000 (EM Act). In June 2007 the Aripo Savannas was declared an Environmentally Sensitive Area. It was designated as a Strict Nature Reserve because it is one of the areas in Trinidad and Tobago with high scientific value, as it is the best remaining example of the types of ecosystems found within its boundaries. This designation makes the area eligible for special protection and management under the laws of Trinidad and Tobago.

Judge grants injunction stopping highway project

Environmental activist group Fishermen and Friends of the Sea (FFOS) has obtained an interim injunction barring the Government from continuing work on the first phase of the $400M Churchill Roosevelt Highway Extension to Manzanilla.

Justice Kevin Ramcharan granted the injunction, which will expire on Monday, during a hearing in the Port-of-Spain High Court yesterday.

FFOS had applied for the emergency injunction late Monday, however, Ramcharan could not determine the case immediately as he and the other parties served with the court documents were unable to read the filings in time.

In the lawsuit filed in September, last year, the group is challenging the process used by the Environmental Management Authority (EMA) for granting a Certificate of Environmental Clearance (CEC) for the first phase of the project between Cumuto and Guaico.

It is claiming that the process was procedural flawed and failed to consider alternative routes for the project, which would have less impact on the area, known as the Aripo Savannas, and to existing communities.

It is also questioning why the EMA took 10 days to publish the CEC in the national register after it was granted on June 22, last year.

In addition to the FFOS’s lawsuit, concerns have been raised over Government’s decision to award the first phase of the project to Kall Co.

Ramcharan asked attorneys for the Ministry of Works and Transport and the National Infrastructure Development Company (NIDCO) if they were willing to consent to stop the work until the substantive injunction application is heard and determined, next Monday. They refused.

Noting that he was not pre-determining the issue, Ramcharan said the interim injunction would help protect the subject matter of the FFOS’s claim.

Under the injunction, Kall Co is only allowed to continue to survey the site, to construct a temporary site office and to remove logs that have already been felled under permission from the Forestry Division of the Ministry of Agriculture.

Presenting submissions on behalf of the group, former attorney general Anand Ramlogan SC claimed that over one kilometre had been cleared since the works began on January 8.

He stated that the works were causing irreparable damage to a forested area, which is home to dozens of species including the endangered ocelot.

“Each passing hour leaves a trail of rampant massacre and destruction of the environment,” Ramlogan said.

Head of the State’s legal team Deborah Peake, SC called upon Ramcharan to disregard the application as she pointed out that the deadline for filing for an injunction set by him had expired.

She also noted that Ramcharan still had to determine whether FFOS should be granted leave to pursue its substantive lawsuit against the highway project.

In response, Ramlogan said his client could not have applied before as Nidco and the ministry had repeatedly said that there were delays in the project.

“It would be rather strange would make such an order to file an application for an injunction restraining something that has not yet occurred,” Ramlogan said.

FFOS is also being represented by Jayanti Lutchmedial, Alvin Pariagsingh and Robert Abdool-Mitchell.

The State is also being represented by Ian Benjamin and Ravi Heffes-Doon.

About Aripo Savannas

The Aripo Savannas is one of three locations across T&T that is designated an Environmentally Sensitive Area by the Environmental Management Authority.

The other two are the Matura National Park and Nariva Swamp. According to the EMA’s website, the area is internationally renowned for its unusual flora and striking vegetation communities and is one of the more intensively studied natural ecosystems in Trinidad.

“The construction of the said highway does not in any way encroach upon the Savannas as is being asserted in some quarters. NIDCO has and continues to act as a responsible State agency and will abide by the terms of the Certificate of Environmental Clearance (CEC) granted by the EMA as seeks to improve the lives of all our citizens,” it said.

Aboud claims High Court order being breached

Environmental activist group Fishermen and Friends of the Sea (FFOS) is accusing the Government of breaching an interim injunction stopping work on the controversial $400 million Churchill Roosevelt Highway Extension to Manzanilla.

Addressing an emergency press conference on the steps of the Hall of Justice in Port-of-Spain yesterday, FFOS secretary Gary Aboud claimed to have evidence of at least four breaches of the injunction, which was granted by High Court Judge Kevin Ramcharan on Tuesday.

Aboud claimed his lawyers felt the action constituted contempt of court and would file such proceedings when application for the substantive injunction comes up for hearing before Ramcharan, on Monday.

“We are not against any road or highway but don’t break the law and defy the court,” an emotional Aboud said.

Under the injunction, the Ministry of Works, the National Infrastructure Development Company (Nidco) and contractor Kallco were stopped from continuing work on the project save and except the construction of a temporary site office, the removal of already felled trees and surveying.

Video footage, which was purportedly recorded by the group between Thursday evening and yesterday morning and distributed to the media, appeared to show excavators digging trenches and clearing a portion of land.

“They are doing major earth works. They are cutting a myriad of drains, remodelling the land and levelling it because it is uneven land. This is a forest reserve,” Aboud claimed.

Aboud also claimed he had additional evidence of new trees being felled, minor natural drainage being diverted and heavy equipment being operated within the 120-metre buffer-zone between the proposed route and the environmentally protected Airpo Savannas forest reserve.

In response to the claims, Works and Transport Minister Rohan Sinanan said he did not want to comment explicitly on Aboud’s allegations as the issue was before the court.

However, he stated: “In the injunction there was certain work that could continue. My information is that that is the work being undertaken at this point in time.”

In a press release issued after the injunction was granted on Tuesday, Nidco stated that it was confident that it had compiled with all statutory regulations before embarking on construction of the highway and disputed FFOS claims on the potential impact of the project.

Nidco’s lawyers had requested the variation of the temporary injunction to exclude the minor works as it claimed that it did not want to incur remobilisation fees from the contractor, which would apply if the project is stopped and restarted.

ABOUT THE LAWSUIT

The injunction that stopped work on the Manzanilla Highway a week ago was extended to Wednesday, when the hearing will continue.

Justice Kevin Ramcharan, in the High Court on Monday, granted the injunction after dismissing an application for leave by the claimant, Fishermen and Friends of the Sea.

Property Matters – State land acquisition

Recent concerns over the State’s land acquisition process, especially in relation to the Curepe Interchange project, have virtually coincided with the appointment on 12th January 2018 of the first Board for the Office of Procurement Regulation (OPR).

The $222M contract for this project was awarded in August 2017 to China Railway Construction Corporation (CRCC) by National infrastructure Development Co. (NIDCO). NIDCO is one of the implementing agencies for the Ministry of Works and Transport, which is headed by Senator Rohan Sinanan. Twenty-Two parcels of private land have to be acquired to build this interchange between the Churchill-Roosevelt Highway and the Southern Main Road. That includes a part of the disused Kay-Donna Drive-Inn Cinema, which is at the south-western corner of that intersection.

Yup how fast men forget project pride. I think it was 480million spent i could be wrong and not one truck load of sand was dropped .

I still waiting for a PNM airport tobe built .

PNM even built barbados airport but not one here in Trini.
